SC strikes down key provisions of Tribunals Reforms Act, says Centre reintroduced quashed clauses

New Delhi, Nov 19: The Supreme Court on Wednesday struck down several provisions of the 2021 Tribunals Reforms law related to the appointment, tenure, and service conditions of members of various tribunals, saying they had been re-enacted by the Centre with minor tweaks.

A bench of Chief Justice B R Gavai and Justice K Vinod Chandran said the impugned provisions violated the principles of separation of powers and judicial independence, and they should not have been brought back.

The bench said that dealing with the backlog of cases was not the sole responsibility of the judiciary, and the onus must be shared by the other arms of the government.

The bench held that Parliament had sought to “legislatively override” binding judicial precedents by re-enacting clauses previously quashed by the court.

“We have compared the provisions of the Ordinance and the 2021 Act, and it shows that all provisions struck down, with minor tweaking, have been re-enacted again,” the CJI said while reading the judgment.

“Thus, we have held that the provisions of the 2021 Act cannot be sustained as it violates separation of powers and judicial independence. It amounts to legislative overriding without curing any defects and binding judgment… It falls foul. Thus, it is struck down as unconstitutional,” he said.

The court restored the earlier judicial directions on tenure, making it clear that members of the Income Tax Appellate Tribunal (ITAT) and the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) shall continue to be in service until the age of 62, while their chairpersons or presidents shall remain in office until the age of 65.

The details of the judgment are awaited.

On November 11, the top court reserved its verdict on a batch of petitions challenging the constitutional validity of the Tribunals Reforms (Rationalisation and Conditions of Service) Act, 2021.

The law abolished several appellate bodies, such as the Film Certification Appellate Tribunal, and amended provisions governing appointments, age criteria, and tenure across the tribunal framework.

Baramulla, Nov 19: Security forces recovered a live Chinese grenade during a routine cordon-and-search operation (CASO) in the Tappar Kreeri area of North Kashmir’s Baramulla district, officials said.

A senior police officer said that the operation was jointly launched by the Special Operations Group (SOG) Kreeri and the 2nd Battalion of the Sashastra Seema Bal (SSB) at the Agricultural Seed Forum in Tappar Kreeri.

During the searches, a live Chinese grenade was recovered from an orchard adjacent to the forum. The explosive has been taken into possession by police, officer added.

New Delhi, Nov 19: A Delhi court early Wednesday sent Al Falah University founder Jawed Ahmed Siddiqui to Enforcement Directorate custody for 13 days.

Siddiqui, who was arrested under the terror-linked money laundering case on Tuesday evening, was produced before Additional Sessions Judge Sheetal Chaudhary Pradhan at her residence close to midnight. The proceedings lasted till 1 am.

The judge said, “After carefully considering the submission made, I am of the considered view that all the compliances under Section 19 of the PMLA (Prevention of money laundering act) have been done.”

“Considering the gravity of the offence and that the investigation is at nascent stage. I deem it appropriate that the accused is granted Enforcement Directorate (ED) custody remand for a period of 13 days,” the judge added.

The ED has alleged that the Al-Falah University falsely claimed that it is a UGC recognised university and misrepresented its NAAC (National Assessment and Accreditation Council) accreditation status.

NAAC is an autonomous body funded by the University Grants Commission (UGC) of India that assesses and accredits higher education institutions in the country.

The agency alleged that the university generated Rs 415.10 crore of educational revenue from 2018-2025 financial year, which saw a “meteoric rise” every year after 2018.

The ED said the university generated Rs 24.21 crore revenue in 2018-2019 which increased to Rs 80.10 crore in 2024-2025.

The agency said, “It is a fact that the entire Al-Falah group has seen a meteoric rise since the 1990s, metamorphosing into a large educational body. However, the financials of the various entities are at variance with the huge amount of assets accumulated by the group.”

Special Prosecutor, Simon Benjamin who appeared in court on behalf of the ED, submitted that its probe found that funds duped from people and student fees were being used for personal and private use.

“Various persons have admitted that matters as regards financial decisions were taken by the arrested accused,” he said.

Seeking 14-day custody, he said custodial interrogation of the accused (Siddiqui) is necessary to “unearth and quantify” the full extent of proceeds of crime.

The agency said, “Accused continues to occupy the position of founder and managing trustee and controlling mind of Al-Falah Charitable Trust and exercises de facto influence over Al-Falah University and its institutions.”

Benjamin said the accused can transfer, mortgage and reroute funds to related entities or individuals to place assets beyond the reach of enforcement, making his arrest necessary.

Siddiqui was taken into custody under the Prevention of Money Laundering Act (PMLA) on Tuesday evening following day-long searches.

The ED on Tuesday arrested Siddiqui after it conducted simultaneous searches in Delhi-NCR against the trustees and promoters of Faridabad-based Al Falah University, linked to the Red Fort area car blast case, officials said.

The ED seized around Rs 48 lakh in cash during the searches at 19 premises of the Al Falah Trust and university.

Police to launch portal for tenant verification

Jammu, Nov 18: Police in Jammu will soon launch a dedicated web portal to streamline tenant verification and reduce the need for people to visit police stations, a senior official said on Tuesday.

Senior Superintendent of Police (SSP) Jammu, Joginder Singh, said the current manual system requires every tenant and landlord to physically visit the police station, which often causes inconvenience.

“We are working to remove this physical contact. A user-friendly tenant verification portal is being developed and will be launched soon,” Singh said.

He said that once active, neither the tenant nor the landlord will need to come to the police station. “Verification forms can be submitted online, and the police will carry out the verification.”

The SSP also said that verification of employees by shopkeepers and employers is mandatory under the orders of the Deputy Commissioner.

“Every shopkeeper or employer must ensure verification of their workers. This is compulsory,” he said.

He clarified that the verification drive is a routine, year-round process, not something triggered by any recent incident.

“Verification continues throughout the year, under which we routinely check and verify individuals,” he said.

On the spread of misinformation on social media, the SSP said the police have urged the government to introduce necessary regulations.

“We have requested that there should be rules to curb fake and wrong information being circulated online. Work is underway, and we hope that regulations will be in place soon,” he added.

Srinagar, Nov 19: The Economic Offences Wing (EOW) of the Crime Branch Kashmir has filed a chargesheet in FIR No. 87/2022 under Sections 209, 409, 420, 467, 468, 471 and 120-B of the IPC before the Court of the Chief Judicial Magistrate, Srinagar, in connection with a high-profile record tampering case involving the Central Administrative Tribunal (CAT).

The chargesheet names Pathan Majid Ahmad Khan of Takia Khan Sopore, Mushtaq Ahmad Rather of Ali Bagh Hygam Sopore, Mudasir Yousuf Wani of Tujjar Sharief Sopore, Ghulam Mohammad Reshi of Yamberzal Wani Sopore, Bashir Ahmad Dar of Bonpora Nowpora Sopore, and Anoop Mishra of Prayagraj, Uttar Pradesh, presently residing near the DC Office Jammu.

The case originated from a communication by the office of the Chief Horticulture Officer, which flagged suspected tampering of documents submitted before CAT in TA No. 4100/2021. Following this, the EOW registered a formal case and began an investigation.

During the probe, officials found that documents submitted before CAT Srinagar had been unlawfully altered while in the tribunal’s custody. Investigators concluded that the prime accused, Pathan Majid Ahmad Khan, in criminal conspiracy with CAT employee Anoop Mishra and other beneficiary employees, had made unauthorised insertions in records related to their regularisation in the Horticulture Department.

Searches led to the recovery of at least twelve official seals of various departments and institutions — including those of the Director Horticulture, BDO, Tehsildar, ZEO, school principals and headmasters — from the residence of Majid Khan. Digital evidence, including Call Detail Records and WhatsApp conversations retrieved from his mobile phone, further corroborated the conspiracy and the role of CAT employee Anoop Mishra.

The chargesheet has now been submitted before the court for judicial determination.

PM Modi to release Rs 18,000 crore funds to farmers, inaugurate farming summit in TN today

Chennai, Nov 19: Prime Minister Narendra Modi will release the 21st instalment of the PM-KISAN income support scheme — amounting to Rs 18,000 crore for over nine crore farmers — during his visit to Coimbatore on Wednesday.

The Prime Minister will also inaugurate the South India Organic Farming Conference being organised by the Tamil Nadu Organic Farmers’ Federation at the CODISSIA campus.

PM Modi is scheduled to arrive at the Coimbatore International Airport from Puttaparthi, Andhra Pradesh. He will be received by Tamil Nadu Governor R.N. Ravi and senior government officials. Around 1.30 p.m., he will travel by road to the CODISSIA Trade Complex, where an elaborate reception has been arranged by the South India Organic Farmers’ Federation.

At the event, the Prime Minister will formally inaugurate the organic farming conference and deliver a keynote address, highlighting the significance of sustainable agriculture. He is expected to speak extensively about the PM-KISAN scheme, under which farmers receive an annual financial support of Rs 6,000 in three instalments.

The 21st instalment to be released on Wednesday will benefit nine crore farmers across India, including 21,80,204 beneficiaries from Tamil Nadu. In Coimbatore district alone, 44,837 farmers will receive assistance.

PM Modi will also honour farmers who have demonstrated excellence in organic farming, presenting them with awards in recognition of their achievements. Following this, he will interact with organic farmers and agricultural scientists, discussing innovations and challenges in sustainable agriculture.

The Prime Minister is also expected to visit stalls set up by organic farmers, where he will review a range of agricultural products and value-added items.

His visit to the CODISSIA complex is expected to last until around 3.30 p.m., after which he will return to the Coimbatore airport to depart for New Delhi.

Thousands of organic farmers from Tamil Nadu, Kerala, Andhra Pradesh, Karnataka, and other southern states have arrived in Coimbatore to attend the conference, which is considered one of the largest organic farming gatherings in the region.

A five-layer security cover has been deployed for the Prime Minister’s visit. The entire CODISSIA campus has been brought under the control of the Special Protection Group (SPG). Police personnel are on duty round-the-clock, and drone operations have been banned in and around the venue.

Tight security measures have also been enforced along the Coimbatore–Avinashi Road leading to the event site.

Washington, Nov 19: Soccer superstar Cristiano Ronaldo was at the White House on Tuesday as President Donald Trump hosted a glitzy dinner to honour Saudi Arabia’s Crown Prince Mohammed bin Salman.

The soccer star was seated near the front of the East Room, not far from where the president and crown prince gave remarks to officials from both nations, along with major business leaders such as Apple CEO Tim Cook and Tesla founder Elon Musk.

Trump, in his speech, made a point of recognising Ronaldo, whom he said he introduced to his teenage son.

Ronaldo has been the face of the Saudi soccer league since joining Saudi club Al-Nassr at the end of 2022 on a reported USD 200 million-a-year contract.

The 40-year-old Portuguese star signed a two-year extension in June with Al-Nassr, which is majority owned by the Saudi sovereign wealth fund that the crown prince chairs.

Trump thanked the athlete for attending. He said that his youngest son, Barron, is a “big fan” of Ronaldo and the 19-year-old was impressed that he got to meet the soccer player.

“Barron got to meet him. And I think he respects his father a little bit more, now, just the fact that I introduced you,” Trump said.

Prince Mohammed was visiting the White House for the first time since a period of diplomatic isolation began in 2018 after the killing of Washington Post journalist Jamal Khashoggi by Saudi agents in a consulate office in Istanbul. US intelligence agencies determined that Prince Mohammed likely directed the operation. He has denied involvement in the killing.

It was a rare US visit for Ronaldo, who hasn’t played in the country since 2014.

In 2017, German news magazine Der Spiegel reported that Ronaldo had years earlier paid USD 375,000 in hush money to a woman who accused him of raping her at a Las Vegas hotel in 2009. Ronaldo’s lawyers maintained the sex was consensual and no criminal charges ever were filed.

World Cup connection

Saudi Arabia will host the 2034 World Cup after FIFA and its president, Gianni Infantino, shaped a fast-track bidding process two years ago that helped ensure there was no rival bid.

Ronaldo promoted that bid, saying last December when the Saudi win was confirmed “after what I see, I’m more convinced that 2034 will be the best World Cup ever.”

Ronaldo is set to play at a record sixth edition of the World Cup next year after Portugal qualified Sunday for the tournament co-hosted by the US, Canada and Mexico. However, he likely will be banned by FIFA for Portugal’s first game next June after getting his first red card last week in 23 seasons playing for the national team.

Portugal will learn its World Cup opponents on December 5 at the tournament draw, which Trump is set to attend at the Kennedy Center in Washington.

Trump has closely aligned himself with the 2026 World Cup. In the Oval Office he has a copy of the golden trophy loaned to him by FIFA President Gianni Infantino.

Snowbound Machil pleads for a gynaecologist

Kupwara, Nov 18: Residents of Machil sector in north Kashmir’s Kupwara district are demanding urgent action from authorities over the decades-long absence of a gynaecologist at the Primary Health Centre in Duddi, a situation they say has cost lives and left pregnant women vulnerable in one of the Valley’s most remote areas.

The snowbound sector, located more than 50 kilometres from Kupwara district headquarters, remains cut off for days during heavy winter snowfall, forcing residents to undertake perilous journeys for basic maternal healthcare.

“During heavy snowfall, traffic on the Kupwara-Machil road remains suspended for several days. Pregnant women bear the brunt of this isolation,” said Habibullah, a resident.

He described emergency evacuations during winter when residents must carry pregnant women on their shoulders for over 20 kilometres to reach Zamindar Gali (Z-Gali), from where they can board transport to Kupwara.

“Several pregnant women have lost their lives for want of timely treatment, yet authorities have not deputed a specialised gynaecologist here,” said Jamal Din, another resident. He added that young unmarried women in the area cannot access care for gynaecological conditions due to the absence of specialised medical staff throughout the entire Machil sector.

Despite repeated appeals to authorities—including requests for a gynaecologist to visit even twice weekly—residents say their pleas have gone unheeded.

“We have moved from pillar to post to get our genuine demand fulfilled, but nothing has been done. We have lost hope,” residents said collectively.

The inhabitants have now appealed to Chief Minister Omar Abdullah and Health Minister Sakina Itoo for immediate intervention to address the healthcare crisis affecting maternal and women’s health in the remote sector.

Govt issues advisory after TV channels air explosive-making content

New Delhi, Nov 18: The Ministry of Information and Broadcasting on Tuesday issued an advisory to all private television channels against telecasting visuals that could aid, abet or promote unlawful activities.

The advisory comes in the wake of certain television channels carrying content on making explosives in the aftermath of the recent blast near the Red Fort in Delhi that left several people dead.

“It has come to the notice of this ministry that some news channels have been broadcasting content related to alleged persons involved in Red Fort blasts, justifying their acts of violence, as well as information videos of how to make explosive material,” the advisory to all private satellite TV channels said.

It said such broadcasts may inadvertently encourage or incite violence, disrupt public order, and pose risks to national security.

“All TV channels are advised to exercise the highest level of discretion and sensitivity while reporting on such matters,” the advisory said.

It cited sections of the Cable Television Network Rules, which state that no programme should contain anything obscene, defamatory, deliberately false, or suggestive innuendos and half-truths; be likely to encourage or incite violence, contain anything against the maintenance of law and order, or promote anti-national attitudes; or contain anything that affects the integrity of the nation.

All TV channels are further advised to avoid telecasting visuals that could aid, abet or promote unlawful activities, the advisory said.
