Srinagar, May 30: The Central Administrative Tribunal (CAT) in Srinagar has asked the five- member expert committee headed by director SKIMS to submit final report which would include the candidates’ experience and qualification accepted by JKPSC for the selection of the post of Deputy Medical Superintendent in Government Medical Colleges (GMC) Srinagar and Jammu.
A division bench comprising M S Latif Member (J) and Prasant Kumar Member (A) sought the report attesting to the committee’s opinion after it observed that the same had not been furnished in keeping with its direction.
“……the committee has not given any opinion as regards those whose experience have been accepted by the Commission, whether the same conforms to the required qualification/experience or not. We would request the committee, headed by the Director, SKIMS, Saura, Srinagar to take note of and to submit his committee’s opinion as regards those whose experience and qualification have been accepted by the commission and whose names have been reflected in the report of the committee, which is un-dated,” the tribunal said.
The selection process for the post of DMS for GMC Srinagar and Jammu was put on hold by the tribunal after the candidature of a candidate, Dr Kulbir Singh Jat, who had worked as ‘Causality Medical Officer’ was not considered by the JKPSC.
Observing that it was indispensable to have an expert opinion, the tribunal directed the government to constitute an exert committee to find out whether working as ‘Causality Medical Officer’ would include ‘running a hospital’ which makes eligible a candidate for the post of Deputy Medical Superintendent in GMC Srinagar and Jammu. Subsequently, the government constituted the panel.
The panel comprising Director SKIMS as its Chairman, Principal Government Medical College Srinagar, and Principal Government Medical College Jammu and Director (Coordination) new GMCs as members besides Secretary J&K Public Service Commission as Member Secretary has been tasked to clarify the qualification prescribed for the post of Deputy Medical Superintendent under the Jammu & Kashmir Medical Education (Gazetted) Service Recruitment rules especially regarding the term “experience of running of hospital”.
Regarding the experience of Dr Jat, the panel in its report filed, noted that the experience certificates provided by the principal, GMC, Anantnag, although seemed to qualify for “running the hospital” but the dates of experience certificates issued were not explicitly clear.
Therefore, the committee after threadbare discussions and perusal of all the documents decided that a separate letter in a sealed envelope be sent to the Principal GMC, Anantnag to get clarification for the period of experience of the aggrieved candidate, Dr. Kulbir Singh Jat, the report said.
The report also indicated that the committee resolved to send experience certificates of all other eligible candidates to the respective issuing authorities for verification,
“Keeping in view the prayer of the committee for extension of time, we allow further time by two weeks’ as prayed for,” the tribunal said and listed the case for further consideration on June 3.
The Court asked the Committee to provide a complete expert final report, as sought for, which would include the petitioner (Dr Jat) as well as all those candidates whose experience and qualification have been accepted by the JKPSC.
