New waste rules from April 1, tighten norms, focus on hilly areas and islands

New Delhi, Jan 28: The Union government has notified the Solid Waste Management (SWM) Rules, 2026, with a special focus on waste handling in hilly regions and island territories, where tourism pressure and limited disposal space pose serious challenges. The new rules replace the 2016 norms and will come into force from April 1, 2026. Issued under the Environment (Protection) Act, 1986, the rules aim to improve segregation, recycling and accountability, while following the “polluter pays” principle. Fines can be imposed for poor waste management, false reporting or operating without registration, with State Pollution Control Boards empowered to collect environmental compensation.

Mandatory four-way segregation: The rules make four-stream segregation at source compulsory: wet waste, dry waste, sanitary waste and special care waste. Kitchen and food waste will be composted or converted into biogas, dry waste will be recycled, while sanitary and hazardous household waste must be stored and collected separately by authorised agencies.

Large waste producers such as government offices, institutions, commercial complexes and housing societies have been clearly defined as bulk waste generators and made responsible for managing their own waste. They must process wet waste on-site wherever possible or obtain certification, a move expected to reduce pressure on urban local bodies.

Special provisions for hills and islands

Recognising their ecological fragility, the rules introduce specific measures for hilly areas and islands. Local bodies can levy user fees on tourists and regulate tourist inflow based on available waste management capacity. Dedicated collection points will be set up for non-biodegradable waste, while hotels and restaurants must process wet waste locally. Residents will be encouraged to hand over waste to authorities and avoid littering. Landfilling has been strictly limited to waste that cannot be recycled or used for energy. Higher fees will be charged for dumping unsegregated waste, making segregation the cheaper option. Old dumpsites will be cleaned up through time-bound biomining and bioremediation.

CS Dulloo assesses roadmap to strengthen disaster preparedness across J&K

Jammu, Jan 28: Chief Secretary, Atal Dulloo today while reviewing the measures undertaken by the Department of Disaster Management, Relief, Rehabilitation & Reconstruction (DMRR&R) to strengthen the Union Territory’s disaster preparedness, response and mitigation framework emphasises on anticipatory action, technology-enabled early warning systems, and seamless inter-agency coordination.

During the meeting, the Chief Secretary was apprised of a comprehensive roadmap for strengthening disaster management across Jammu and Kashmir, which has been developed by incorporating lessons learnt from recent extreme weather events, post-disaster reviews and national-level consultations with agencies such as the National Disaster Management Authority (NDMA) and the India Meteorological Department (IMD).

The meeting was attended by the Additional Chief Secretary, Public Works Department; Principal Secretary, DMRR&R; Commissioner Secretary, Forests; Commissioner Secretary, General Administration Department; Divisional Commissioner, Jammu/Kashmir; Secretary, Rural Development Department; Director General, Budget; Chief Executive Officer, Economic Reconstruction Agency, and other senior officers.

Deputy Commissioners from all districts participated virtually.

The Chief Secretary urged the department to take steps for implementation of the disaster mitigation framework without further delay, stressing the need for strong inter-departmental coordination to ensure effective execution of the roadmap on the ground. He also called for regular monitoring and close supervision at senior levels to track progress and ensure accountability.

He directed the Divisional and District Administrations to ensure timely updation of their respective District Disaster Management Plans (DDMPs) and to periodically review the status of preparedness and mitigation measures undertaken at their level.

Emphasizing preparedness as the cornerstone of disaster management, the Chief Secretary underscored the mandatory conduct of pre-monsoon preparedness measures by all districts, particularly for floods and other weather-induced disasters during the April to September period, which has historically witnessed a higher frequency of such events in the UT.

The Chief Secretary called for RFID-based management of pilgrimages, particularly the Machail Mata Yatra, along with creation of the requisite supporting infrastructure along the yatra route. He also stressed the importance of conducting shrine-specific mock exercises, including at the Shri Mata Vaishno Devi Shrine, to ensure coordinated and timely response during emergencies.

He further enjoined upon the Deputy Commissioners to remain vigilant in view of the risk of avalanches following recent snowfall and directed them to ensure the prompt restoration of road connectivity, drinking water supply and electricity to all affected habitations in their respective districts.

Speaking on the occasion, Principal Secretary, DMRR&R, Chandraker Bharti, highlighted the critical importance of strengthening last-mile dissemination of weather warnings, enhancing public awareness and promoting the adoption of digital platforms such as the SACHET App. He emphasized that District and Sub-Divisional Emergency Operation Centres (EOCs) must be made functional with redundant communication systems, particularly in remote and border areas.

The review highlighted a clear strategic shift from reactive disaster response to a more anticipatory disaster management approach, supported by improved early warning systems, preparedness planning and the integration of modern technology.

The presentation also captured key operational insights from recent incidents, including the Chasoti flash flood during the Machail Mata Yatra in Kishtwar, cloudburst impacts in Doda, and floods in parts of the Jammu region including Kathua and other areas. These experiences have informed a series of targeted improvements in planning, response and coordination mechanisms.

To enhance safety during major pilgrimages and other high-footfall events, the roadmap envisages systematic pilgrim registration and RFID-based monitoring, regular pre-monsoon coordination meetings at the UT and Corps levels, and the conduct of table-top exercises and mock drills at the district level. It also provides for clearly defined Standard Operating Procedures (SOPs) to regulate movement during adverse weather conditions and the establishment of Joint Control Rooms involving the Civil Administration, Army, CAPFs and SDRF.

Infrastructure-related measures include the construction of Yatri Niwas, comprehensive mapping of permanent and temporary helipads, pre-positioning of medical and engineering resources, and integration of civil helicopters into the overall disaster response planning framework.

The review emphasized the need for localized and valley-specific weather forecasting, deployment of Automatic Weather Stations (AWS) and Doppler Radars in high-risk areas, and the use of drones for delivery of essential supplies and medicines to cut-off regions.

Moreoveroperational gaps identified during recent flood events, such as communication shortfalls, absence of sub-divisional EOCs and limited availability of satellite phones, are being systematically addressed.

Additionally it was highlighted to expedite the key strategic infrastructure projects including the Indri Bridge over River Chenab at Pargwal, river training works on Chenab and Tawi, and targeted mitigation measures to reduce flood susceptibility of River MannawarTawi, noting its strategic significance.

The roadmap clearly delineates the roles and responsibilities of the UT Government, District Administrations, IMD, NDMA, Armed Forces, CAPFs, BRO, NDRF and SDRF, and provides for strengthened inter-agency coordination.

Major initiatives include the conduct of an annual state-level mock exercise every June (pre-monsoon), organization of one-day IDRN workshops for Himalayan states, finalization of SOPs for drone usage in disaster response in coordination with the DGCA and Indian Air Force, pre-positioning of HADR equipment and bridging resources, and strengthening of ‘Aapda Mitras’, including engagement of trained local divers in vulnerable districts.

Sector-specific preparedness measures were also reviewed, including shrine-specific mock exercises for the Shri Mata Vaishno Devi Shrine, tunnel contingency drills by the Railways, and regional forest fire mock exercises by the Forest Department.

The Chief Secretary directed time-bound implementation of all agreed action points and reiterated that disaster management in Jammu and Kashmir must remain people-centric, technology-enabled and coordination-driven, with preparedness, rather than response alone, forming the cornerstone of the Union Territory’s disaster risk reduction strategy.

Delhi HC dismisses Er Rashid’s plea challenging framing of charges in terror funding case

New Delhi, Jan 28: The Delhi High Court on Wednesday rejected a plea by jailed Lok Sabha MP from Jammu and Kashmir’s Baramulla, Sheikh Abdul Rashid alias Engineer Rashid, challenging the framing of charges against him in a terror funding case.

A bench of Justices Prathiba M Singh and Madhu Jain said the appeal by Rashid against the trial court order was not maintainable.

It noted that a coordinate bench of the high court has already, in another case, held that an appeal was not maintainable against an order of framing charges as the same was not a final order.

“The present appeal would also not be maintainable and is dismissed as being not maintainable,” said the bench.

The senior counsel appearing for the National Investigation Agency (NIA said that Rashid’s appeal was filed after a delay of 1100 days, which should not be condoned.

The court said since the appeal itself was not maintainable on merit, it was not going into the aspect of delay.

Rashid has been lodged in the Tihar jail since 2019 after he was arrested by the National Investigation Agency (NIA) under the Unlawful Activities (Prevention) Act in the 2017 terror funding case.

The Baramulla MP, who defeated Omar Abdullah in the 2024 Lok Sabha polls, is facing allegations that he funded separatists and terror groups in Jammu and Kashmir.

According to the NIA’s FIR, Rashid’s name cropped up during the interrogation of businessman and co-accused Zahoor Watali.

After being chargesheeted in October 2019, a special NIA court framed charges against Rashid and others in March 2022 under sections 120B (criminal conspiracy), 121 (waging war against the government), and 124A (sedition) of IPC and for offences relating to terrorist acts and terror funding under UAPA.

A Delhi court has allowed Rashid to attend the Budget Session of Parliament, which commenced on Wednesday, under custody parole, whereby a prisoner is escorted by armed police personnel to his place of visit.

Jammu, Jan 28: A rusted mortar shell was recovered from a village near the Line of Control (LoC) and was diffused in a controlled explosion in Poonch district of Jammu and Kashmir on Wednesday, officials said.

The mortar shell from Pakistan had landed in the village during operation Sindoor in May last year, they said.

Some villagers noticed the shell and informed the local Army unit and police, the officials said, adding a bomb disposal squad was rushed in, and the mortar was destroyed.

Kupwara, Jan 28: Security forces on Wednesday recovered a cache of arms and ammunition during a Cordon and Search Operation (CASO) conducted in the Karnah sector of north Kashmir’s Kupwara district.

The officials said that the joint operation was carried out by Karnah Police in the Rati Tari forest area of Sector Taad, Karnah.

During the operation, security forces recovered arms, ammunition which includes 4 Chinese Pistols, 7 Pistol Magazines, 3 AK Magazines, 308 rounds of AK-47, and 1 Sniper Sight.

The officials have initiated further investigation to ascertain the source and intended use of the seized arms and ammunition.

New Delhi, Jan 28: Prime Minister Narendra Modi on Wednesday expressed grief over the death of Maharasthra Deputy Chief Minister Ajit Pawar in a plane crash and said he had made big contributions in the development of the western state and India, especially in uplifting rural lives.

Addressing a gathering at the PM National Cadet Corps (NCC) Rally at Delhi Cantonment here, the prime minister said fate took away Ajit Pawar and a few others in an accident on Wednesday morning in Pune district.

Modi welcomed the gathering, largely of NCC cadets, with a heavy heart and expressed grief over the demise of Pawar (66).

“‘Ajit dada’ made big contributions in the development of Maharashtra and India, especially in uplifting rural lives. I express my condolences to his family members. We stand with the kin of those who lost their lives today (in the crash),” he said.

Nationalist Congress Party (NCP) leader Pawar and four others were killed in the plane crash.

The incident occurred when the deputy chief minister was travelling to Baramati from Mumbai to address public meetings as part of the NCP’s campaign for the February 5 zilla parishad elections in the state. There were five people on board when the aircraft crashed at 8.50 am, a police official said.

Earlier in the day, Modi posted on X, “Shri Ajit Pawar Ji was a leader of the people, having a strong grassroots level connect. He was widely respected as a hardworking personality at the forefront of serving the people of Maharashtra.”

“His understanding of administrative matters and passion for empowering the poor and downtrodden were also noteworthy. His untimely demise is very shocking and saddening. Condolences to his family and countless admirers. Om Shanti,” Modi said.

Srinagar, Jan 28: The Government of Jammu and Kashmir has ordered a detailed enquiry into the circumstances and events that led to the circulation of videos on social media platforms in connection with Government Medical College (GMC), Udhampur, on January 27, 2026.

As per Government Order No. 67-JK (HME) of 2026, dated January 28 as per news agency Kashmir News Corner — KNC, sanction has been accorded to the appointment of Prof. (Dr.) Ashutosh Gupta, Principal, Government Medical College, Jammu, as the Inquiry Officer to probe the matter.

According to the order, the inquiry will examine the sequence of events and look into the administrative, security and institutional aspects related to the incident(s) at GMC Udhampur that resulted in the circulation of the videos on social media.

The Inquiry Officer has been directed to submit a reasoned and comprehensive report within 15 days from the date of issuance of the order.

Ganderbal, Jan 28: Ganderbal Police on Wednesday issued an advisory, urging general public, tourists and transporters to strictly avoid visiting or halting in avalanche-prone areas. The advisory comes after an avalanche hit New Truck Yard, Sonamarg, last night around 10:15 pm.

According to officials, the impact of the avalanche was minimal and no loss of life or property has been reported. Police team along with SDRF timely reported in the area to assess the situation.

The official said that concerned agencies are closely monitoring the situation, and precautionary measures are being kept in place to ensure public safety in the region.

The police in an advisory issued urged general public, tourists and transporters to avoid visiting or halting in avalanche-prone areas. It said the chances of avalanches remain very high, and unnecessary movement in vulnerable zones can pose serious risks.

“People are urged to follow official advisories, cooperate with local authorities, and prioritize safety while traveling through the Sonamarg axis and adjoining areas,” advisory reads.

Ganderbal Police remain committed to the safety and well-being of the public and request everyone to stay alert and act responsibly, it added.

New Delhi, Jan 28: The Delhi High Court on Wednesday granted four weeks to the National Investigation Agency (NIA) to respond to a reply filed by separatist leader Yasin Malik to its appeal seeking death penalty for him in a terror funding case, and listed the matter for hearing on April 22.

As Malik, who was virtually appearing from Tihar jail where he is serving life sentence in the case, accused the agency of “wasting time” and causing him “trauma” by “taking dates” in the appeal filed in 2023, a bench of Justices Navin Chawla and Ravinder Dudeja said there was no urgency in the case.

“There is no urgency. This is for enhancement of sentence. You are already on life sentence,” the bench remarked.

The court gave four weeks as “last opportunity” to the NIA to file its rejoinder.

NIA counsel submitted that Mailk filed a lengthy reply to the agency’s appeal, which even had content “not related” to the case, and the rejoinder was being vetted.

He also objected to Malik’s claim of NIA seeking repeated adjournments, and said Malik himself took one year to file his reply to the appeal.

He further informed the court that the agency was seeking an in-camera hearing in the matter.

A trial court in Delhi awarded Malik — chief of the banned Jammu and Kashmir Liberation Front (JKLF)– life sentence on May 24, 2022, after holding him guilty of various offences under the stringent Unlawful Activities (Prevention) Act (UAPA) and the Indian Penal Code (IPC).

The NIA filed an appeal in 2023 in the high court seeking enhancement of his life term to the maximum punishment of death penalty.

In its plea before the high court for enhancement of sentence to death penalty, the NIA said if such “dreaded terrorists” are not given capital punishment on account of pleading guilty, there would be complete erosion of the sentencing policy and the terrorists would have a way out to avoid capital punishment.

A life sentence, the NIA asserted, is not commensurate with the crime committed by terrorists when the nation and families of soldiers have suffered loss of lives and the trial court’s conclusion that Malik’s crimes did not fall within the category of the “rarest of the rare cases” for grant of death penalty is “ex-facie legally flawed and completely unsustainable”.

In his reply filed to the NIA’s appeal, Mailk said that he spent nearly three decades as a key figure in a state-sanctioned “backchannel” mechanism, working with a succession of prime ministers, intelligence chiefs, and even business tycoons to foster peace in Jammu and Kashmir.

In an 85-page affidavit submitted before the Delhi High Court, Malik shared details about his journey from his school days to links with terrorists and meetings with political leaders.

He claimed the state was attempting to “erase” the history of engagement.

Malik said “being a scapegoat in politics isn’t a new thing, it’s a kind of a new normal but being a sacrificial goat is something which goes beyond the shard of high handedness of morality, if at all politics had one”.

SC agrees to list for hearing plea against UGC regulation

New Delhi, Jan 28: The Supreme Court on Wednesday agreed to list for hearing a plea challenging a recently notified University Grants Commission (UGC) regulation on the ground that it has adopted a non-inclusionary definition of caste-based discrimination and excludes certain categories from institutional protection.

A bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi took note of the submissions of a lawyer seeking urgent hearing of the plea.

“There is a possibility of discrimination against the general class. My case is ‘Rahul Dewan and Ors vs Union’,” a lawyer said.

“We know what is happening. Make sure defects are cured. We will list it,” the CJI said.

The new regulations mandating all higher education institutions to form “equity committees” to look into discrimination complaints and promote equity were notified on January 13.

The University Grants Commission (Promotion of Equity in Higher Education Institutions) Regulations, 2026, mandated that these committees must include members of the Other Backward Classes (OBC), the Scheduled Castes (SC), the Scheduled Tribes (ST), persons with disabilities, and women.

The new regulations replaces the UGC (Promotion of Equity in Higher Educational Institutions) Regulations, 2012, which was largely advisory in nature.

The plea assailed the regulation on the grounds that caste-based discrimination is defined strictly as discrimination against members of the SCs, STs and OBCs.

It said that by limiting the scope of “caste-based discrimination” only to SC, ST and OBC categories, the UGC has effectively denied institutional protection and grievance redressal to individuals belonging to the “general” or non-reserved categories who may also face harassment or bias based on their caste identity.

Protests are held at various places against the regulations, with student groups and organisations demanding its immediate rollback.
